Extended Deadline for Filing a WTC Notice of Participation Form

WTC Notice of Participation Form

On November 21, 2014, legislation was enacted that extends the deadline for filing a written and sworn WTC Notice of Participation form with the Fire Pension Fund to September 11, 2015. If you are eligible and have not yet filed a WTC Notice of Participation form, CLICK HERE. This completed, notarized form must be received by the Fire Pension Fund no later than September 11, 2015.

Once received, the Department will attempt to confirm your information by verifying the tours worked with payroll data. Members whose information is unable to be confirmed will be required to obtain and forward independent verification of participation to the Fire Pension Fund. Documentation may include, but is not limited to, a signed, notarized affidavit from department superiors who can attest to and affirm your work at the WTC site for the requisite number of hours during one of the qualifying periods as indicated on the WTC Notice of Participation form, along with his or her contact information. Such additional documentation will be subject to further review.

Members who were employed by another agency on September 11, 2001 must contact the former agency to obtain verification. The former agency must provide the Fire Pension Fund with a letter attesting the member has met the requirements for participation.

In order to be covered by the WTC Disability Law, a member who becomes disabled by a qualifying WTC condition must have performed one of the covered activities in one of the covered locations during one of the qualifying periods. Details are set forth below:

    Covered Activities and Locations

  • Participated in the rescue, recovery or clean-up operations at the WTC site, defined as “anywhere below a line starting from the Hudson River and Canal Street; east on Canal Street to Pike Street; south on Pike Street to the East River, and extending to the lower tip of Manhattan).
  • Worked at Fresh Kills Landfill.
  • Worked at the New York City Morgue or temporary morgue on pier locations on the west side of Manhattan.
  • Manned the barges between the west side of Manhattan and the Fresh Kills Landfill.
  • Repaired, cleaned or rehabilitated vehicles or equipment owned by NYC that were contaminated by debris in the WTC site, regardless of whether the work was done at the WTC site, provided such work was performed prior to decontamination.
    Qualifying Periods

  • Any member who participated in rescue, recovery or cleanup operations during any period within the 48 hours after the first plane hit the towers.
  • Any member who participated in the WTC “rescue, recovery or cleanup operations” for at least 40 hours accumulated any time between September 11, 2001 and ending September 12, 2002.
  • You may check the status of your participation from the Fire Department Intranet by selecting “WTC Notice of Participation” from the “Applications” drop-down menu, and then entering your Tax Registry Number. Please note that the form is for notification purposes only and does not constitute an application for retirement or reclassification. In order to apply for retirement benefits, a separate application must be completed.
